Kamala Harris (D-CA) Introduces Bill That Attacks Freedom of Speech

WASHINGTON, DC. Former Democrat candidate for President in 2020, and current U.S. Senator, Kamala Harris (D-CA) introduced a bill (116th Cong, 2nd Session, S. Res. 580, PDF) to prohibit phrases such as “Chinese Virus,” “Wuhan Virus” and “Kung Flu” as ‘racist,’ and therefore, such phrases should be banned.

The bill is in most likely a response by President Donald J. Trump and some in the media who have at times referred to the Coronavirus as the “China Virus,” and “Wuhan Virus.”

The bill however goes beyond such phrases as to banning “all forms” of what may be perceived as derogatory speech.

Although one may question the use of derogatory terms on private citizens, such “offensive” speech is technically protected speech; Texas v. Johnson, 491 USC § 397 (1989). As harsh as it may seem to some, even hate speech is protected speech; R.A.V. v. St. Paul, 505 USC § 377 (1992).

Now if one used speech to incite violence, that is not protected speech; Brandenburg v. Ohio, 395 USC § 444 (1969).

In fact, the U.S. Supreme Court held 9-0 that the U.S. government could not interfere with dissent speech made on-line. The High Court said that on-line speech deserves the highest First Amendment protection – the same protections as for newspapers and books, Reno v. American Civil Liberties Union, 521 USC § 844 (1997).

Harris’ Senate bill is backed by 25 Senate Democrats including Co-California Sen. Diane Feinstein (D-CA), Sen. Amy Klobuchar, Sen. Elizabeth Warren (D-MA), and Sen. Bernie Sanders (I-VT), all who clearly demonstrate their lack of support to the U.S. Constitution.

Senator Harris, Klobuchar, and Warren are all lawyers by trade, University of California, Hastings; University of Chicago, Law; and Harvard, Law respectively. Harris is the former California State Attorney General from 2011-2017. None of their respective law schools have spoken out in regard to this unconstitutional bill.

Our view is Senator Harris’ bill will go nowhere. It will not even be up for a vote, let alone pass the GOP-Controlled Senate. Nor will the Bill be signed into law by President Trump.

Regardless of who is in office, the California Senator’s bill is clearly unconstitutional, and would ultimately be struck down by the U.S. Supreme Court.
